In brief

Your memories and photographs are used to write your Story, and for nothing else.

They are never sold, never shared with advertisers, and never used to train AI systems.

You may ask us to delete everything we hold about you at any time.

1. About this policy
1.1 This policy explains what personal information ishling magic collects, why we collect it, how it is used, who we share it with, and the choices available to you.
1.2 In this policy, we, us and our mean ishling magic. You means the person visiting our store, placing an order, or communicating with us. Personal information means information that identifies you, or that could reasonably be used to identify you.
1.3 We are the data fiduciary in respect of the personal information described in this policy. We are based in Hyderabad, India.

2. Personal information we collect
2.1 Information you give us. Your name, email address, telephone number, and the material you send us for the Story  -  which may include written memories, voice notes, photographs, and documents you choose to share.
2.2 Information about your order. Order details, delivery information, payment status, and your transaction history with us.
2.3 Information collected automatically. When you use our store we collect information about your device, browser and network connection, including your IP address and other unique identifiers, and information about how and when you interact with and navigate the store. This is collected through cookies and similar technologies.
2.4 Communications. The content of messages you send us, for example when you contact us with a question.

3. Where we get it
3.1 Directly from you, when you place an order, create an account, or communicate with us.
3.2 Automatically, from your device and through cookies when you use our store.
3.3 From our service providers, including Shopify, who collect or process information on our behalf.
3.4 We do not buy personal information about you from third parties, and we do not use data brokers.

4. How we use it
4.1 To write, design and deliver the Story you have ordered.
4.2 To process your payment, fulfil your order, and manage your account.
4.3 To correspond with you about your order, including revisions.
4.4 To keep our store secure and to detect, investigate and prevent fraudulent or unlawful activity.
4.5 To meet our legal and accounting obligations.
4.6 We do not use your information to show you targeted advertising, and we do not use it for marketing without your consent. If we ever send you a newsletter, you will have opted in, and every message will have a one-click unsubscribe.

5. Artificial intelligence and training
5.1 Your photographs and the memories you share are not entered into AI systems and are not used to train any AI model.
5.2 Every Story is written by a person.
5.3 We believe you should be able to tell the difference, and we will always tell you plainly.

6. Children's information
6.1 Many of our Stories are about a child. Where that is the case, the child's information  -  including their name, photographs and details  -  is supplied to us by an adult: usually a parent, grandparent or legal guardian.
6.2 We do not collect information directly from children, and our store is not intended to be used by children.
6.3 Where a Story concerns a child, we require the consent of the child's parent or legal guardian before we process that child's information. When you place an order concerning a child, you confirm that you are that child's parent or legal guardian, or that you have their consent to share the child's information with us for the purpose of creating the Story.
6.4 We do not use children's information for tracking, behavioural monitoring, or targeted advertising of any kind.
6.5 If you believe a child's information has reached us without appropriate consent, contact us at ishlingmagic@gmail.com and we will delete it.

7. Who we share it with
7.1 We share information only with the service providers needed to operate our store, principally Shopify, which provides our storefront, order processing, payments and hosting.
7.2 We do not sell your personal information. We do not share it with advertisers, marketing partners or data brokers.
7.3 We may disclose information where we are legally required to do so, for example in response to valid legal process.
7.4 We do not share your Story or your photographs publicly. We will not publish or refer publicly to your Story without your written permission.

8. Shopify's role
8.1 Our store is hosted by Shopify. Shopify collects and processes personal information about your access to and use of our store in order to provide and improve its services to us.
8.2 Information you submit is transmitted to and shared with Shopify and with third parties that may be located in countries other than where you live.

9. International transfers
9.1 We may transfer, store and process your personal information outside the country in which you live  -  including on servers operated by us or by Shopify and its sub-processors.
9.2 Where we transfer personal information internationally, we take reasonable steps to ensure it receives an appropriate level of protection.

10. How long we keep it
10.1 We keep your material while we are writing your Story, and for a reasonable period afterwards, so that revisions remain possible.
10.2 We will delete your photographs, story material and personal details on request.
10.3 We may retain limited order records for as long as we are required to do so for legal or accounting purposes.

11. Your rights
11.1 You may ask us to:
(a) confirm what personal information we hold about you, and provide a summary of it;
(b) provide a copy of it;
(c) correct anything that is inaccurate or out of date; and
(d) erase it, where we are not required to keep it. 11.2 You may also withdraw any consent you have given us. Where you do, we may be unable to complete your order.
11.3 To exercise any of these rights, email ishlingmagic@gmail.com. We will respond in a reasonable time.
11.4 You may nominate another person to exercise these rights on your behalf. If you do, we will ask that person to show that you have authorised them, and we may also need to verify your identity directly.

12. Complaints
12.1 If you are unhappy with how we have handled your information, please contact us first at ishlingmagic@gmail.com, and we will try to resolve it.
12.2 If you are not satisfied with our response, you may lodge a complaint with the Data Protection Board of India.

13. Security
13.1 We take reasonable steps to protect your information, including limiting access to it to those who need it in order to fulfil your order.
13.2 No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive information to us through insecure channels.

14. Changes to this policy
We may update this policy from time to time. The date at the top of this page shows when it was last revised. Where changes are significant we will provide notice as required by applicable law.
